A suit contesting the eligibility of Asiwaju Bola Ahmed Tinubu to become the presidential candidate of the All Progressive Congress (APC) ahead of the general elections has been thrown out, Vanguard reports.
Justice Binta Nyako who presided over the case seeking for the disqualification of the former Lagos state governor said the litigant lacked the legal right to implement the action.
The judge of the federal high in Abuja, on Friday, January 25, 2023, further stated that the litigant suing Tinubu is not a registered member of the APC and therefore the case can not be solidified.
The federal high in Abuja, on Friday, January 25 dismissed the application urging INEC to delist Tinubu from the list of candidates billed to contest in next month’s presidential polls.
Justice Nyako also disclosed that the plaintiff had contested Tinubu’s candidacy but was dismissed because it lacked merit.
The court also accused the petitioner of abusing the legal process by delving into a multiplicity of legal actions.
